CORPORATE POLICY ON PREVENTION OF SEXUAL HARASSMENT AT WORKPLACE

[Under The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013]

  1. Sexual Harassment is a serious criminal offence, which can destroy human dignity and freedom. In an effort to promote the well-being of all women Employees at the workplace, the following policy is released.
  2. This policy is called ‘Prevention of Sexual Harassment Policy’.
  3. This policy is released in line with the “The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.”
  4. The policy provides for the prevention of sexual harassment of Women Employees at their workplaces by their Employers, Superiors, and Colleagues or by anyone connected with the workplace and matters connected therewith.
  5. “sexual harassment” includes any one or more of the following unwelcome acts or behavior (whether directly or by implication), namely:—
    • Physical contact and advances; or
    • A demand or request for sexual favours; or
    • Making sexually coloured remarks; or
    • Showing pornography, or
    • Any other unwelcome physical, verbal, or non-verbal conduct of a sexual nature;
  6. “Woman” means and includes a woman employed, whether directly or through any agency, in any establishment, and/ or any visitor, customer, supplier, etc.
  7. As per the applicable Laws (BNS 79/ S.509 of IPC) in India, whoever sexually harasses women at a workplace shall be punished with simple imprisonment for a term that may extend to three years, and also with fine].
  8. In addition, the conduct of sexual harassment amounts to misconduct in employment, and therefore, management would initiate appropriate disciplinary action.
  9. The Management will take all necessary and reasonable steps to assist the affected person in terms of support and preventive action.
  10. If the Management gets any complaint of sexual harassment from any female Employee or by any other person connected with the company’s affairs, the Management will take appropriate action against the guilty person in accordance with the Rules and Regulations of the Organization, as well as the Act of 2013, and under Bharatiya Nyaya Sanhita (BNS) 2023
  11. The Management will exercise its duty to promote an atmosphere of healthy cooperation between male & female Employees in which sexual safety and dignity of women Employees is maintained and respected. The Management will also prevent and deter the committing of any act of sexual harassment at the workplace.
  12. The Management will take appropriate steps to prevent sexual harassment of any nature, including those enumerated in the above definition. The express prohibition of sexual harassment as defined above at the workplace is notified and published herewith and will be evaluated in an appropriate manner.
  13. The company is registered with She-Box, an online portal by the government of India for women to register complaints of sexual harassment at their workplace under its IC registration number -2501100223. Employees can make use of it where appropriate. The List of IC members is attached herewith.
